Acceptable Use
You may use the Site only for lawful, personal purposes. You may not engage in unlawful or fraudulent activities; provide false information; impersonate another person; introduce malicious code; interfere with Site security; attempt unauthorized access; or copy, scrape, or misuse Site content in violation of applicable law or our rights.
We may restrict access if we reasonably believe these Terms have been violated.
Products and Product Information
We make reasonable efforts to provide accurate product descriptions, images, materials, measurements, availability, and prices. Colors and appearance may vary due to lighting, photography, and device settings.
Natural gemstones, pearls, and handcrafted products may vary in color, pattern, texture, dimensions, and weight. Such variations are not necessarily defects. Measurements and weights may be approximate unless otherwise stated.
We may modify or discontinue products or services, subject to applicable law. Warranty coverage and claim procedures are described in our Warranty Policy.
Orders, Payments, and Taxes
Submitting an order is an offer to purchase. An automated order confirmation acknowledges receipt but does not necessarily constitute acceptance. We accept an order when we send a shipping confirmation or otherwise expressly confirm acceptance.
We may refuse or cancel an order because of product unavailability, payment failure, suspected fraud, shipping restrictions, violation of these Terms, or an obvious pricing or product-information error.
If we cancel an order after payment has been processed, we will refund the original payment method. Posting times depend on your payment provider or financial institution.
Prices, currencies, and available payment methods are displayed at checkout. Applicable taxes may be calculated at checkout. Recipients of international orders may be responsible for customs duties, import taxes, VAT/GST/HST, brokerage fees, and similar charges unless otherwise stated at checkout or in our Shipping Policy.
Shipping, Insurance, Returns, and Refunds
Shipping methods and estimated delivery times are described in our Shipping Policy. Delivery dates are estimates unless expressly guaranteed and may be affected by carriers, customs, weather, holidays, or circumstances outside our reasonable control.
Shipments are insured while in transit. Risk of loss or damage remains with Nobel Yates until delivery to the shipping address, as shown by the carrier’s delivery or signature record, except as otherwise required by law.
If an order is confirmed lost or damaged in transit, we will provide an appropriate remedy, which may include replacement or refund. We may request photographs, packaging, or other information needed to process a claim.
Customers are responsible for providing an accurate shipping address. Returns, exchanges, cancellations, and refunds are governed by our Refund and Return Policy.
Nothing in these Terms limits any consumer right that cannot lawfully be waived.
Intellectual Property
The Site and its content—including text, photographs, graphics, logos, designs, videos, software, and trademarks—are owned by or licensed to Nobel Yates and protected by applicable intellectual property laws.

Reviews and User Content
If you submit a review, photograph, comment, or other content, you confirm that you have the right to provide it and that it does not violate applicable law or another person’s rights.
You grant Nobel Yates a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, and publish that content in connection with operating and promoting our business, subject to our Privacy Policy. We may remove unlawful, misleading, abusive, or infringing content.

The Site may include third-party applications, payment services, tools, or links. These services may be governed by their own terms and privacy policies. We do not control or guarantee their content, availability, or practices.
Disclaimer and Limitation of Liability
To the fullest extent permitted by law, the Site and its content are provided on an “as available” basis. We do not guarantee uninterrupted, error-free, or completely secure operation.
Nobel Yates will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the Site or purchase of our products. Where liability may lawfully be limited, our total liability for a claim will not exceed the amount paid for the product giving rise to that claim.
Nothing in these Terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited, including liability for fraud or for death or personal injury caused by negligence where applicable.
Events Beyond Our Control
We are not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, severe weather, labor disputes, carrier disruptions, customs delays, government restrictions, or utility and communication failures. This does not limit any non-waivable consumer rights.
Governing Law and Disputes
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
Subject to applicable consumer protection laws, disputes relating to these Terms or the Site will be brought before a court of competent jurisdiction in New York. Nothing in these Terms limits a right to bring a claim elsewhere when that right cannot lawfully be waived.

If any provision of these Terms is invalid or unenforceable, the remaining provisions will remain effective. These Terms and the incorporated policies constitute the agreement between you and Nobel Yates regarding the Site and your purchases.
